1. Agreement to Terms

By accessing or using EmpireCollisionDallas.com ("Site"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our website.

 

2. About Empire Collision

Empire Collision ("we," "our," "us") operates an auto body and collision repair business located in Dallas, Texas. The Site provides information about our services and allows users to submit contact forms, request estimates, and schedule appointments.

In addition to repair and restoration services, Empire Collision also purchases vehicles — including damaged, wrecked, or used cars — through its "We Buy Cars" program.

 

3. Use of Our Website

You agree to use this Site only for lawful purposes and in a way that does not infringe on the rights of others or restrict their use of the Site.

You agree not to:

        Use the Site to send false, misleading, or fraudulent information.

        Attempt to gain unauthorized access to any part of the Site or our systems.

        Copy, distribute, or exploit any part of our content without written permission.

 

4. Submitting Contact Information

When you submit your name, phone number, email, or vehicle details through our online forms:

        You confirm that the information is accurate and belongs to you.

        You consent to being contacted by phone, text, or email regarding your inquiry, estimate, or appointment.

        We may store your information as outlined in our Privacy Policy.

Submitting a form does not constitute a guaranteed sale or service agreement until confirmed by an authorized representative of Empire Collision.

 

5. Vehicle Appraisal and Cash Offers

Empire Collision offers cash offers for vehicles ("We Buy Cars Dallas") as part of its operations. By submitting your vehicle for an appraisal or offer:

        You confirm you are the legal owner or authorized seller of the vehicle.

        You agree to provide accurate information regarding the vehicle's make, model, mileage, title status, and condition.

        Any offer provided online, by phone, or email is a preliminary estimate only and subject to in-person inspection of the vehicle's condition and title status.

        Empire Collision reserves the right to adjust, withdraw, or decline offers at its sole discretion if discrepancies are found.

All transactions are final once both parties agree to terms and payment has been issued. Vehicles sold to Empire Collision become the property of Empire Collision upon transfer of title and receipt of payment.

 

5a. Title Issues

If a vehicle's title is found to carry undisclosed liens, encumbrances, or legal holds after an offer has been made, Empire Collision reserves the right to withdraw the offer or renegotiate terms. Resolution of any title defects is the sole responsibility of the seller prior to transfer.

 

5b. Fraudulent Seller Liability

Any person who sells or attempts to sell a vehicle they do not legally own, or who provides false information regarding title, ownership, or vehicle condition, assumes full legal and financial liability for resulting damages. Empire Collision will cooperate fully with law enforcement in such cases.

 

6. Estimates and Service Information

All repair estimates or quotes provided through this website or by phone or email are subject to in-person inspection of your vehicle. Prices and turnaround times may vary based on vehicle condition, parts availability, and other factors.

Empire Collision reserves the right to decline service requests, modify pricing, or refuse to purchase any vehicle for any reason.

 

6a. Supplemental Repairs

In the event that additional damage or repair needs are discovered after work has begun, Empire Collision will notify the vehicle owner prior to performing any supplemental repairs. Additional work will not proceed without the owner's explicit written or verbal authorization. Supplemental repairs may affect the final cost and estimated completion date.

 

7. Insurance Claims and Payment Responsibility

Empire Collision works with all major insurance providers and will assist customers in processing insurance claims. However, the vehicle owner — not the insurer — is the client of record and is ultimately responsible for all charges not covered by the insurance settlement.

If an insurance supplement or payment does not fully cover the cost of agreed-upon repairs, the owner is responsible for the remaining balance prior to vehicle release. Empire Collision is not responsible for disputes between the owner and their insurance carrier regarding coverage amounts or claim decisions.

 

8. Parts Warranty

Empire Collision provides a lifetime warranty on workmanship and paint finish for as long as the original customer owns the vehicle. This warranty covers defects in labor and finish resulting directly from repairs performed by Empire Collision.

This warranty does not cover:

        Damage caused by subsequent accidents, misuse, or neglect.

        Normal wear and tear.

        Damage resulting from improper maintenance or repairs performed by third parties after the vehicle leaves our facility.

The warranty is non-transferable and does not apply to vehicles that have been sold or transferred to a new owner after the original repair.

 

9. Abandoned Vehicles

In accordance with Texas law, any vehicle left at Empire Collision for more than 10 days after written or verbal notice that repairs are complete may be considered abandoned. Empire Collision reserves the right to assess daily storage fees and, if applicable, pursue a mechanic's or storage lien under the Texas Property Code.

Empire Collision will make reasonable attempts to contact the vehicle owner prior to initiating any lien process. Customers are encouraged to arrange timely vehicle retrieval to avoid additional fees.

 

10. Storage Fees

Vehicles that remain at Empire Collision's facility beyond 3 business days after repair completion and customer notification may be subject to a daily storage fee. Storage fees will be disclosed to the customer upon notification of repair completion. Empire Collision reserves the right to withhold release of the vehicle until all outstanding charges, including storage fees, have been paid in full.

 

11. Personal Property Disclaimer

Empire Collision is not responsible for any personal property, valuables, or items left inside a vehicle during the repair or storage period. Customers are advised to remove all personal belongings from their vehicle prior to drop-off. Empire Collision shall bear no liability for lost, stolen, or damaged personal items left in vehicles on our premises.

 

12. Pre-Existing Damage

A condition report may be conducted at the time of vehicle intake to document pre-existing damage not related to the current repair. Empire Collision is not responsible for damage that was present prior to the vehicle's arrival at our facility. Customers are encouraged to review and acknowledge the intake condition report at the time of drop-off.

 

13. Force Majeure

Empire Collision shall not be held liable for delays in repair completion caused by circumstances beyond our reasonable control, including but not limited to parts shortages, manufacturer delays, supply chain disruptions, extreme weather events, natural disasters, labor strikes, or government-imposed restrictions. In such cases, Empire Collision will communicate updated timelines to the customer as information becomes available.

 

14. Mechanical Conditions and Liability

Empire Collision provides collision repair, body work, and paint services only. We are not responsible for any pre-existing, undiscovered, or unrelated mechanical, electrical, or drivetrain issues in any vehicle received for service, unless such issues are separately identified, quoted, and agreed upon in writing prior to work beginning.

In the event that a mechanical concern is identified during the course of body repair, Empire Collision will notify the vehicle owner. If the owner chooses to retrieve the vehicle prior to allowing an Empire Collision technician to inspect or address the identified mechanical concern, the owner assumes full responsibility for the vehicle and any resulting damage, safety risk, or liability arising from that condition. Empire Collision shall bear no responsibility for any incidents, injuries, or damages occurring after the vehicle leaves our facility under those circumstances.

Customers will be asked to acknowledge this policy at the time of vehicle drop-off and/or upon retrieval of their vehicle. A signed or initialed repair order confirming notification of any identified mechanical concern shall serve as binding acknowledgment of the customer's assumption of responsibility.

 

15. SMS and Text Message Consent

By providing your phone number and checking the consent box on any Empire Collision form, you agree to receive transactional text messages related to your repair status, appointment reminders, estimate updates, and review requests. Message frequency may vary. Standard message and data rates may apply.

You may opt out at any time by replying STOP to any message. For help, reply HELP. Empire Collision does not sell or share your phone number with third parties for marketing purposes. Consent to receive text messages is not a condition of receiving services.

 

16. Dispute Resolution

In the event of a dispute arising from services rendered, vehicle purchases, or any transaction with Empire Collision, the parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, the parties agree to submit the dispute to non-binding mediation in Dallas County, Texas before pursuing litigation.

Nothing in this section prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction where necessary to prevent irreparable harm.

 

17. Intellectual Property

All text, images, graphics, logos, and content on this Site are the property of Empire Collision or its licensors and are protected by copyright and trademark laws. You may not reproduce, modify, or use our content without express written permission.

 

18. Third-Party Links

This Site may include links to third-party websites (e.g., insurance partners, financing providers, or affiliates). We are not responsible for the content, accuracy, or privacy practices of any third-party site.

 

19. Disclaimer of Warranties
